Fox Lake man found not guilty of fifth OWI

JUNEAU – A 56-year-old Fox Lake man was found not guilty of a fifth offense of drunken driving after about three hours of deliberation by a Dodge County jury Wednesday night.

Timothy McMahon appeared for a two-day jury trial and was represented by attorney Andrew Mishlove on fifth offense operating a motor vehicle while intoxicated charges.

According to the criminal complaint, a Dodge County sheriff’s deputy responded to a report Jan. 15, 2017, at 9:20 p.m. that a vehicle had gone through the ice on Fox Lake near the peninsula north of the river’s mouth. The caller reported that the truck had gone through but the man and a dog had gotten out of the truck. McMahon was located by EMS and fire personnel as he walked from the shoreline at the dead end of Indian Point Road.

McMahon, allegedly had a blood alcohol reading of 0.167, which is more than double the legal limit. The complaint also said that he told officers that he had consumed a few beers while ice fishing that day.
