Elyria man faces felony charges after domestic violence incident, attack on police officers, police say

ELYRIA, Ohio -- An Elyria man was arrested Tuesday after a domestic violence incident led to a brawl with two police officers, according to Elyria police.

Samuel Marmolejos, 23, faces felony charges of assault and obstructing official business along with misdemeanor charges of assault, domestic violence and resisting arrest, Elyria Municipal Court record show. 

Police responded about 4 p.m. Tuesday to Marmolejos’ home in the 1000 block of Melvyn Lane for a call about a domestic incident, according to a police report. An eyewitness told officers that a man had a loud argument with a woman in the driveway of the home, the report says.

The man sat in the driver’s seat of a car while the woman stood near the opened passenger door, the eyewitness said. The man backed the car out of the driveway at a high speed with the passenger door still open, striking the woman’s arm. The man got out of the car and started walking down the street, the eyewitness told police.

Two officers found a man matching the suspect’s description about a block away, according to a police report. One officer ordered Marmolejos to walk toward their patrol cruiser, and the other ordered him to put his hands behind his back, but Marmolejos refused, the police report says. 

An officer approached Marmolejos and tried to grab his right arm, the report says. Marmolejos pulled away like he was going to run, so the other officer grabbed his left arm, but Marmolejos again pulled away, the report says. 

An officer wrapped his arm about Marmolejos, pulling all three to the ground. Police tried to control Marmolejos’ arms while repeatedly saying, “Samuel, you are under arrest, stop fighting,” according to the police report. 

Marmolejos reached his left hand toward his pants pocket, police say. For fear that he might have been arming himself, an officer struck Marmolejos in the left arm with his knee, the police report says. 

Marmolejos then tried to disarm an officer by reaching for loaded magazines on the officer’s vest carrier, police say. The officer’s partner then punched the right side of Marmolejos’ face, after which officers took control of both his arms and legs to place him into handcuffs.

Officers returned to the home on the 1000 block of Melvyn Lane where Marmolejos had been living for the past five months with his girlfriend, according to the police report.

His girlfriend told police they got into an argument that afternoon and said Marmolejos never touched her. She said the car’s passenger door did not hit her in the driveway but came very close, the report says. She did not have any injuries and did not want to press charges against Marmolejos.

Two of his girlfriend’s family members, who also live at the house, told police they were pushed by Marmolejos and had visible scratches and red marks from the incident, the report says. At least one of the family members told officers she wanted to press charges and seek a protection order. 

Elyria Municipal Court Judge Gary C. Bennet heard testimony from a family member before he set Marmolejos’ bond at $12,250 with a stipulation that he is to have no negative contact with the alleged victims.

“If an argument begins or voices start to raise, defendant must leave the residence,” court records say.

Marmolejos is set to appear for a preliminary hearing Oct. 29 before Judge Robert C. White.
