Oregon man sentenced to prison for birthday party shooting

PORTLAND, Ore. (AP) — An Oregon man has been sentenced to prison for shooting two men because of noisy children at a birthday party.

KPTV-TV reported Wednesday that Franklin L. Tomes was sentenced Wednesday to more than seven years in prison.

Tomes pleaded guilty to two counts of attempted murder.

Authorities say Jose Gaeta and Tristan Smith were wounded during the May 2018 shooting in Newport.

Police say Gaeta and Tomes argued over the noise Gaeta’s children were making in the apartment above Tomes.


Authorities say Tomes used a rifle to shoot at the men across a parking lot of the apartment complex 122 miles (196 kilometers) southwest of Portland.

Court records say Smith’s apartment where the men fled was also fired upon.

Authorities say Tomes was arrested after a standoff with police.
