The Latest: Legal fight over Lake Tahoe rental home rules

RENO, Nev. (AP) — The Latest on a legal fight over a ban on most vacation rentals at South Lake Tahoe, California (all times local):

City officials in South Lake Tahoe, California say they intend to work with local property owners to make sure new restrictions on short-term vacation rentals at the mountain resort doesn’t disrupt the plans of visiting families who want to spend the holidays there.

City Manager Frank Rush Jr. told The Associated Press on Thursday they don’t intend to immediately enforce a new cap on the number of people who can stay in rental homes as long as they don’t violate other rules aimed at stemming neighborhood disturbances.

A group of property and business owners on the south end of the lake along the California-Nevada line filed a lawsuit Wednesday to block the new rental rules votes approved in November.

They say the ban on most vacation rentals that begins in 2021 is unconstitutional and the capacity restrictions that already have gone into effect can’t be enforced legally.

Rush says the city wants to act reasonably and has no intention of taking a “hardline approach” given that many people already have made their lodging and transportation reservations for the holidays.

Property and business owners at Lake Tahoe are suing to block new restrictions on short-term vacation rentals they say are wreaking havoc on visiting families planning to spend the holidays at the mountain resort.

A lawyer for the South Lake Tahoe Property Owners Group hoped to secure a temporary injunction Wednesday in California’s El Dorado County Superior Court suspending the new rental rules voters approved in November.

But Andrew Pierce says Judge Michael McLaughlin cited an unspecified conflict of interest and recused himself from the case. A new hearing date hasn’t been set yet.

A ban on short-term rentals affecting 1,400 properties outside South Lake Tahoe’s main tourist corridor doesn’t begin until 2020.

But Pierce says a cap on the number of people who can stay in a rental home already has gone into effect. He says it’s unconstitutional.
