One person dead in Barboursville shooting

BARBOURSVILLE — One person is dead and another is in custody after a confrontation in Barboursville Tuesday resulted in a shooting.

The incident, which took place in the 5200 block of Heath Creek Road, was reported at about 12:15 p.m. when a man called 911 and said he had been attacked by another man and proceeded to shoot him.

According to Sgt. J.L. Joyce of the West Virginia State Police, an occupant of the Heath Creek Road residence died after the alleged shooter drove up to the home and started a confrontation.

The victim has been identified as Phillip Boggs, 70, who according to Joyce, was found shot twice and was dead upon arrival. The shooter was still at the residence and has been

identified as Armel Stutler, 66. He is charged with first-degree murder.

“The victim tried to defend himself and the altercation was brief,” Joyce said. “At that point in time, the suspect pulled out a gun and shot and killed the victim, who was a gentleman renting the house.”

The man appears to be claiming self-defense, Joyce said. He reported the incident to 911, remained at the scene and was cooperating with the investigation.

“We are still trying to piece everything together,” Joyce said. “We are not exactly sure what the altercation was about. The guy who shot him was still here waiting. I’m not saying he’s trying to claim self-defense, but it would look that way. He didn’t run. He didn’t flee. We’ve got the gun. We are just trying to put it all together.”

The shooter was taken into custody at the residence.

One neighbor said the victim was a friendly man who would often mow other neighbors’ lawns or take care of pets when neighbors fell ill. The woman, who was visiting with friends along Heath Creek Road on Tuesday afternoon, said they didn’t even know the shooting had occurred until police arrived at the house because of a nearby gun range, which had been in use at the time of the incident.
