Released by mistake, going back for 10 years

A Fort Wayne man mistakenly released from jail more than five years ago was sentenced Friday to 10 years in prison for a shooting and a robbery from 2012.

Arnel O. Davis, 29, pleaded guilty in June to charges of aggravated battery and robbery in separate cases. He was freed in January 2013 from the Allen County Jail “due to a clerical error” beyond his control, according to court documents, and was arrested again this year.

Davis shot a man once in the stomach and twice in the back following an argument in September 2012, court documents allege. He robbed a pizza delivery driver two months later, taking “about 14 or 15 dollars,” the documents said.


Prosecutors charged Davis with attempted murder, aggravated battery, criminal recklessness with a deadly weapon, carrying a handgun without a license and robbery, but he pleaded guilty only to the battery and robbery charges as part of a plea agreement.

Judge John Surbeck sentenced him Friday in Allen Superior Court to 10 years in prison on the aggravated battery charge and 10 years on the robbery charge. The sentences will be served together.

Davis did not speak during the sentencing hearing.
