The judge issued the ruling in favor of 73-year-old Reynold Buono Dec. 26, saying prosecutors failed to meet the evidentiary threshold required of cases that exceed the 27-year statute of limitations.
Buono was a teacher at Milton Academy until he was fired in 1987 when the headmaster learned he was accused of sexually assaulting a student.

Frederick Weichel was convicted in the 1980 killing of Robert LaMonica.
A judge overturned LaMonica's conviction Monday, finding that authorities failed to give the defense a police report suggesting another possible suspect.
Authorities release name of woman found dead in Dedham
DEDHAM, Mass. (AP) — Authorities have identified the skeletal remains found in a wooded area of suburban Boston last week and now they're trying to figure how what happened to the woman.
Norfolk District Attorney Michael Morrissey on Monday said the remains found in Dedham last week are those of 22-year-old Susan Anyanwu-Corbin.
Morrissey says it's too early to determine how Anyanwu-Corbin died or whether she was the victim of foul play, but he is asking anyone who knew her to come forward.

Yan Long Chow pleaded not guilty Thursday in Norfolk Superior Court to first-degree murder. He was ordered held without bail.
Prosecutors say Chow had told police he accidentally hit Zhen Li in the driveway on Sept. 2. The 52-year-old Li died at the scene.
Man convicted of running over woman, dragging body 3 miles
DEDHAM, Mass. (AP) — A judge has convicted a Massachusetts man of running over a hotel worker four years ago and dragging her body more than 3 miles.
The Norfolk District Attorney's Office says 25-year-old Moses Acloque, of Norwood, was convicted on Tuesday of charges including motor vehicle homicide and leaving the scene of an accident after causing death. Sentencing is planned for mid-March.
Suspect in Boston barbershop killing held without bail
BOSTON (AP) — A man named William Shakespeare who's suspected of killing another man at a Boston barbershop in front of the victim's 4-year-old son has been held without bail.
The 29-year-old Shakespeare, of Dedham, pleaded not guilty at his arraignment Wednesday to first-degree murder and gun charges in the June 14 shooting of 31-year-old Marcus Hall.
Shakespeare was indicted last year but wasn't arrested until late January when he was tracked down in New York City.
