Beatrice man sentenced for sexual assault

A Beatrice man who sexually assaulted a minor last year was sentenced to 3-5 years in prison.

Cody A. Haynes, 27, was sentenced in Gage County District Court Wednesday for attempted first-degree sexual assault of a minor. The charge was reduced from first-degree sexual assault of a minor as part of a plea agreement, while additional charges of child abuse and contributing to the delinquency of a child were dismissed.

Haynes’ defense attorney Dustin Garrison requested a probation sentence and argued that the victim initially consented to the act, though Judge Rick Schreiner said a prison sentence was necessary in the case.

“I know that it is your opinion that what happened was consensual and he somehow changed his mind later on and said that it wasn’t,” he said. “That may very well be why the state of Nebraska has set an age of consent. Young people that age just simply aren’t capable of making those types of decisions.”

Haynes was arrested last September after the 15-year-old boy was taken to Beatrice Community Hospital where a sexual assault exam was completed.

Police said the boy went to Haynes’ residence on the afternoon of Sept. 9. The victim said he had been drinking alcohol prior to arriving at the residence and said he got tired and asked to lay down on the couch.

He reported that Haynes then had sexual intercourse with him, arrest documents state.

During an interview with police, Haynes said that sexual intercourse had occurred with the boy as reported, but denied it was against the boy’s will.
