Judge Throws Out Simpson Suit

LOS ANGELES (AP) _ A judge threw out O.J. Simpson’s breach of contract lawsuit against attorney Robert Kardashian, ruling that Simpson failed to prove his former friend and lawyer violated their attorney-client privilege.

The case involves a CBS miniseries examining the defense strategies of the so-called ``dream team″ of lawyers that successfully defended Simpson against charges of killing his ex-wife and her friend in 1994.

``We’re very disappointed by the judge’s decision,″ said Simpson attorney Adam Belsky. ``We think it was wrong, both legally and factually.″

He said an appeal of the ruling, issued Friday, was being considered.

Simpson went to court earlier this year to halt the making of ``American Tragedy: The Uncensored Story on the Simpson Defense.″ The show, scheduled to air in two parts on Nov. 12 and 15, is based on Lawrence Schiller’s book ``American Tragedy.″

When a judge refused to halt production, Simpson sued Schiller and Kardashian instead.

He claimed Schiller, who he had hired to write a book telling his side of the story, violated privacy agreements between the two and that Kardashian revealed information protected by attorney-client privilege.

Wasserman had dismissed the action against Schiller on Monday.

``I think an appeal would be frivolous, just like the initial lawsuit,″ said Kardashian’s attorney, Erica Tabachnick. ``Schiller and Kardashian were exercising their First Amendment rights.″

Simpson was acquitted in criminal court of killing his ex-wife Nicole Brown Simpson and her friend Ronald Goldman, but was later held liable in civil court and ordered to pay $33.5 million in damages.
