Officer ruled justified in fatal shooting of Burlington man

BURLINGTON, Iowa (AP) — A prosecutor says no charges will be filed against a policeman who shot and killed a fleeing 27-year-old Burlington resident.

Assistant Iowa Attorney General Scott Brown concluded Thursday that the Oct. 1 shooting of Marquis Jones by Burlington officer Chris Chiprez was a justifiable homicide.

Officers stopped Jones for a loud music violation, but he fled on foot. Brown says Jones had a gun in his hand when he struggled with Chiprez’s partner before fleeing again.

Brown says Chiprez fired seven shots at Jones after he refused officers’ orders to drop the gun. Chiprez fired an eighth shot after Jones fled into a backyard.

Brown says Jones died from a single shot, but it’s unclear which one. He says Chiprez didn’t know Jones had dropped the gun before the final shot.

Brown says Chiprez had “no other alternative than to shoot under the circumstances.”
