Moron of the Morning: Wheelchair DUI

James Richard Greene of Waldport, Oregon was under the influence of alcohol and other drugs when he rolled his wheelchair into a crosswalk and careened into a moving pickup truck on October 16, 2012. One month later, the District Attorney’s Office charged him with DUI.

He was found guilty at a trial in June 2013. He appealed the charge.

This week, the Appeals Court declared Greene a “pedestrian” under the definition of Oregon law and wrote that his motorized wheelchair didn’t fit the legal definition of a vehicle.

The reversal will undo the conviction on Greene’s record and the $1,500 fine will be remitted.
