Police say no charges in fatal May shooting in Fort Smith
FORT SMITH, Ark. (AP) — Police say no charges will be filed against a Department of Homeland Security employee who fatally shot a man who had opened fire on an apartment complex in Fort Smith, killing an 87-year-old woman.
Wallace West was off-duty when he shot and killed Zachary Brian Arnold on May 15, according to Fort Smith police spokesperson Aric Mitchell.
“It is the belief of this Department, confirmed by (the) decision of the Sebastian County Prosecutor to not file charges, that Mr. West acted lawfully when he shot Mr. Arnold,” Mitchell said in a news release Wednesday.
Arnold fired 93 shots from a semi-automatic rifle at the complex, killing Lois Hicks inside her apartment, before West, with a bolt-action rifle, shot and killed Arnold, police said.
Both Hicks and Arnold were dead at the scene, Mitchell said, and there were no other injuries in the shooting.
