Convicted ex-judge’s request for prison release withdrawn

January 29, 2019

LITTLE ROCK, Ark. (AP) — A former Arkansas judge has withdrawn his request to be released from prison while he challenges his conviction on bribery charges.

Court records show Michael Maggio’s request for release was approved Monday. Maggio’s motion does not explain why he wished to withdraw his request and the Arkansas Democrat-Gazette reports that his attorney declined comment.

Maggio is serving a 10-year sentence after pleading guilty in 2015 to lowering a jury’s judgment in a negligence lawsuit against a nursing home from $5.2 million to $1 million in exchange for indirect donations to his campaign for a seat on the Arkansas Court of Appeals. Maggio later withdrew from the race.

Previous efforts to withdraw his appeal have failed.

Former state Sen. Gilbert Baker pleaded not guilty to charges that he conspired with Maggio.
