Turnbull Law Firm P.C. and TorHoerman, Law, LLC Team Up, Sue Juul Labs, Alleging Former Athlete Suffered Permanent Lung Damage from Vaping

April 21, 2020 GMT

ATLANTA--(BUSINESS WIRE)--Apr 21, 2020--

Today, personal injury firms Turnbull Law Firm, P.C. and TorHoerman Law, LLC filed the State of Georgia’s first lawsuit against vaping giant Juul Labs, Inc., claiming the company’s electronic cigarettes caused a former athlete to sustain permanent lung injuries and require lifelong medical treatment.

Alan Holcomb, Partner at Turnbull Law Firm, P.C., a partner of The Law Center, and Jake Plattenberger, Partner at TorHoerman Law, LLC, claim Juul Labs negligently formulated their products with harmful chemicals that damage consumers’ lungs. Holcomb and Plattenberger allege that Juul Labs failed to adequately warn the Plaintiff and the public of the dangers of their products, resulting in their client’s condition.

“There’s this misconception that vaping is a healthier alternative to smoking cigarettes, but these devices are simply nicotine delivery systems just like traditional tobacco cigarettes. Once you fall for the marketing campaigns and try it, you don’t stand much of a chance,” says Alan Holcomb, Partner at Turnbull Law Firm. “Our client, a former athlete, now faces a disease for which there is no cure. He has a long, frustrating and painful road ahead of him.”

Plattenberger’s and Holcomb’s client began using Juul Labs products in 2015, according to the claim, and as result of alleged exposure to various chemicals in the Juul device, developed severe and permanent lung injuries, pain, suffering and emotional distress. The lawsuit says Juul Labs knew, or should have known, about the dangerous propensities of the chemicals at the time the products were designed, but chose to include them in the products in an effort to attract young people and new users to electronic cigarettes.

Holcomb and Plattenberger allege Juul Labs knowingly concealed knowledge of the presence of harmful chemicals contained in its product from the general public.

“Since entering the market, Juul Labs has dominated the e-cigarette industry and now controls the vast majority of the market,” Said Plattenberger. “Our hope is to set a precedent for the victims of Juul Lab’s dangerous products and misleading marketing campaigns.”
